INFORMED PATIENT CONSENT FOR WEIGHT LOSS PROGRAM: I, [patient name], declare that I have been informed by Best Ever Body LLC of the cost of the treatment, the treatment modalities, the side effects, the possible alternative treatments, the possible risks and complications that may result from this treatment and in doing so I hereby and forever discharge Best Ever Body LLC, its officers and employees from all claims, demands, actions and cause of action arising out of the performance of this treatment. I have reviewed my medical history, medications, recent illnesses, and recurring illnesses with the staff. I have had all my concerns and questions answered prior to starting treatment. I have reviewed this document in its entirety and agree to the terms of my contract. I will not be prescribed the medication or maybe taken off if I have a normal BMI.

Drug Labeling · All non compound medications, have labeling approved by the FDA. This labeling contains suggestions of the use of the medication. The labeling found on most appetite suppressants is based upon studies of less than 12 weeks using the dosage indicated on the labels. ·The semaglutide used for Best Ever Body is ordered through a compound pharmacy that is an accredited 503A compounding pharmacy and has a 503B outsourcing facility designed with the FDA's current good manufacturing practices (CGMP's) in mind. "Drug compounding is often regarded as the process of combining, mixing, or altering ingredients to create a medication tailored to the needs of an individual patient. Compounded drugs are not FDA approved. Various entities may inspect facilities, including state boards of pharmacy and FDA. Generally, state boards of pharmacy have primary responsibility for the day-to-day oversight of state licensed pharmacy that are not registered with the FDA as outsourcing facilities. FDA does not conduct surveillances and of-cause inspections of state-licensed pharmacies that are not licensed as outsourcing pharmacies. Facilities that are register with the FDA as outsourcing facilities under section 503B are primarily overseen by the FDA and inspected by the FDA according to a risk-based schedule.” (U.S. Food & Drug Administration, 2022) · Notwithstanding such labeling, I understand that my medical provider, based upon his/her experience, the experience of his/her colleagues, and other factors, may recommend the use of such medications for a period or at doses more than those recommended by the manufacturer’s label. I further understand that such usage may not have been systemically studied as that suggested by the labeling, and it is possible, as with many other medications, that serious side effects could occur. · After consulting the provider, I believe that the probability of such side effects is outweighed by the potential benefit of the appetite suppressants being prescribed and/or provided to me, notwithstanding the fact that the dosage and/or term may exceed those recommended by the manufacturer.

Instructions · I understand that it is my responsibility to follow my provider’s instructions carefully and to report any medical problems immediately, regardless of whether I think that it may be related to my weight control program. · I am not pregnant now and I will report if I become pregnant to my provider immediately. · I understand any treatments rendered are solely for the purpose of weight control. The diagnosis and treatment of other illnesses or diseases is not the responsibility of Best Ever Body LLC If I become ill, I will seek treatment on my own and I will discontinue the use of diet medication until it is determined safe to resume the weight control program.

Diet and Exercise · I understand that there are other ways and programs that can assist me in my desire to decrease my body weight and to maintain any weight loss. In particular, a balanced diet combined with physical exercise is recommended, with or without the use of appetite suppressants. I understand that a program including a revised diet and physical exercise could prove successful without appetite suppressants if I followed it, even though I would probably be hungrier than if I used appetite suppressants.

Risk of Treatment · I understand that this authorization is given to me with the knowledge that the use of appetite suppressants poses various health risks, including but not limited to, pulmonary hypertension, nervousness, sleeplessness, headaches, dry mouth, weakness, fatigue, psychological problems, medical allergies, high blood pressure, rapid heartbeat, and heart irregularities. These and other possible risks could occasionally be serious or even fatal.

Risk of Obesity · I understand that remaining overweight or obese poses certain risks. These are high blood pressure, diabetes, heart disease, heart attack, arthritis, chronic pain, and cancer. I understand that these risks may be modest if I am not very overweight, but these risks increase significantly with any weight gain.

No Guarantees · I understand that much of the success of this program will depend on my efforts. I understand that there are no guarantees or assurances that the program will be successful. I also understand that I will have to continue watching my weight all my life to be successful.

Best Ever Body LLC Procedures · The number of patients we see a day is limited and by appointment only. ·

I will notify Best Ever Body 24 hours in advance if I am unable to keep my appointment otherwise, I will incur a No Show Fee of $50. Most insurance companies do not provide coverage for weight loss programs. All services must be paid for in full at the time services are rendered. We accept cash, check, debit, or charge. There is a 3.4% convenience fee added to all credit/debit cards. · I will not sell or share my medications with anyone. · I will not visit another office for the purpose of obtaining additional or duplicate medications of the same type. · Lab Studies I will provide labs that are less than 12 months old (new labs must be obtained before any refills if greater than 12 months old) for review. The labs are reviewed for the purpose of the weight loss program only. They are not to diagnose and treat medical conditions. They are not a substitute for seeking medical attention. It is my responsibility to seek medical care with my PCP. Copies of lab studies will be provided upon request. Lab fees are my responsibility, and I will not be reimbursed for lab fees by Best Ever Body LLC if I am unable to participate in the weight loss program.

Our Legal Responsibility: We are required by law to give you this notice. It provides you with how we may use and disclose protected medical information about you and describes your rights and our obligations regarding the use and disclosure of that information. We shall maintain the privacy of protected health information and provide you with notice of our legal duties and privacy practices with respect to your protected health information. We have the right to change these policies at any time. If we change our privacy policies, we will notify you immediately. This current policy is in effect unless stated otherwise. If this policy is changed it will apply to all your current and past health information. You may request a copy of this information at any time. How We May Use or Disclose Your Protected Health Information: The following examples describe ways we may use your protected health information for your treatment, payments, healthcare operations, etc. Please be advised not every use or disclosure in a particular category will be listed. Treatment: We may use and disclose your protected health information for your treatment. This includes disclosing your protected health information to other medical providers, trainees, medical staff, and office staff that are involved in your care.

Healthcare Operations: We may use or disclose your protected health information to operate this medical practice. These activities include training students, reviewing cases with employees, utilizing your information to improve quality of care, and contacting you by telephone, email, or text to remind you of appointments. We will not disclose your protected health information for any other purpose other than those identified in this policy without your specific, written authorization. You can revoke this authorization at any time but it will not affect your protected health information that was shared while the authorization was in effect.

Appointment Reminders: We may contact you via telephone, text or email with reminders that you have upcoming appointments. Public Health Risk: We may disclose your protected health information, if necessary, in order to prevent or control disease, report adverse effects from medication or products, prevent injury, disability, or death. This information may be disclosed to healthcare systems, government agencies, or public health organizations. We may have to disclose your protected health information to the FDA to report adverse effects, defects, problems, enable recalls, if required by FDA regulations.

Health Oversight Activities: We may disclose your protected health information to health oversight agencies for audits, investigations, inspections, or licensing purposes. The disclosures may be necessary for state and federal agencies to monitor healthcare systems compliance with civil law.

Required By Law: We will disclose your protected health information when required to do so by federal, state, and/or local law. Lawsuits: We may disclose your protected health information in response to court action, administrative action, or a subpoena.
Local Law: We may disclose your protected health information to law enforcement official in response to a court order, subpoena, warrant, subject to all applicable legal requirements.

Your Right Regarding Your Protected Health Information Access to Medical Records: You have the right to access and receive copies of your protected health information that we use to make decisions about your care. You must submit a written request to obtain your protected health information to the individual listed at the end of this privacy policy.

Amendment: If you believe the protected health information, we have about you is incorrect or incomplete, you may ask us to amend the information. You will need to submit a written request on why you feel the health information should be amended. We may deny your request to amend the information. If we deny the request we will provide you with a written explanation.

Accounting and Disclosures: You have a right to receive an accounting of disclosures of your health information made by this medical practice, except that this medical practice does not have to account for the disclosures provided to you or pursuant to your written authorization, or as described in paragraphs treatment and health care operations, or disclosures for purposes of research or public health which exclude direct patient identifiers, or which are incident to a use or disclosure otherwise permitted or authorized by law, or the disclosures to a health oversight agency or law enforcement official to the extent this medical practice has received notice from that agency or official that providing this accounting would be reasonably likely to impede their activities.

Restriction Request: You have the right to request restrictions or limitations in which we disclose on the protected health information we disclose about you for treatment or healthcare operations. We shall accommodate your request except where the disclosure is required by law. We require this to be a written request submitted to the individual at the end of the policy.

Confidential Communication: You have the right to request that we communicate with you about healthcare matters in a certain way in a certain location. We must accommodate you if it is reasonable and allows us to continue to collect payments. Complaints:If you believe your privacy right have been violated, you may file a complaint with our office. You may also file a complaint with the US Department of Health and Human Services.

I understand that follow up appointments are an important part of my care at Best Ever Body, LLC. I agree to the follow up time frame of 6 weeks, 12 weeks, and every 3 months thereafter. I understand these follow up appointments are essential for assessing my health and tracking my progress.

I understand that if I am prescribed phentermine, which is a controlled substance, I agree to monthly follow-up appointments. I understand I can withdrawal from the program at anytime for any reason.

I understand that if I chose not to follow up on stated timeframes, my medications will not be refilled.

I also understand I can be refused or terminated as a client/patient at any time for reasons deemed appropriate by Best Ever Body LLC. I understand that Best Ever Body LLC does not tolerate rude or offensive behavior, verbal or non-verbal, and I will be terminated as a client/patient if I exhibit any of these behaviors.

The staff at Best Ever Body LLC is here to assist you in your journey of health and beauty. These policies are put in place to help us achieve the best environment and care for clients and staff.

We do not accept insurance; we do not fill out insurance paperwork or complete prior authorizations.

We require a $50 deposit to schedule new patient appointments, this will go towards the cost of the new patient visit and is refundable in the event your appointment is canceled within 48 hours of your appointment.

If you are 15 minutes late for your appointment you will have to reschedule your appointment.

Payment is due at the time of service.

No shows will be charged $50. Any outstanding fees for NO Shows will have to be paid in full before we schedule any follow-up appointments.

If you need to contact Best Ever Body between sessions, please call our office or send us a message though the web site. If we are not immediately available, we will make every effort to return your message within 24 hours. Please do not leave multiple messages, this delays our response time.

If you are in need of emergency assistance, please call 911 or go to the nearest emergency room.

ELECTRONIC COMMUNICATION: We cannot ensure the confidentiality of any form of communication through electronic media, including but not limited to: text, telephone, email, internet, fax. Telemedicine is broadly defined as the use of information technology to deliver medical services and information between two parties that are at two different locations. The above electronic means of communication are considered telemedicine. Utilizing telemedicine services through Best Ever Body is voluntary in nature and you need to understand:

1. You have the right to withhold or withdraw your consent for telemedicine or in office visit services at any time.

2. We will protect your protected health information in the same fashion as a brick-and-mortar practice. You need to understand that through that data breaches can happen, and we cannot assure your information is 100% protected.

3. We will not use your protected health information for research purposes unless you give us consent to do so.

4. There are potential benefits including, but are not limited to improved access to care, reducing cost, improving the quality of visits, and reducing travel time associated with medical visits. The medical provider will make assessments, diagnosis, and treatment plans based off all the visual and auditory information provided during the video conference. You must understand that this is limited and post potential risks including, but not limited to, the provider’s ability to make complete diagnostic assessments that may require a physical examination an see the patient in person. During an in-person encounter, a medical provider has the ability to see the entire patient including but not limited to their gate, smell, general appearance, and demeanor. Potential consequences thus include the provider not being aware of clinically significant information that you may not recognize as significant to present to the provider.
